Terms and Conditions

Last updated: [23/03/2026]

These Terms and Conditions (“Terms”) set out the contractual basis on which Measured Survey Bristol provides measured building surveying services to its clients. By engaging us, accepting a written quote, or instructing us to commence work, you agree to be bound by these Terms.

Please read these Terms carefully. If you have any questions, please contact us before commissioning any work.

About Us

These Terms apply to services provided by:

  • Company name: Measured Survey Bristol
  • Trading address: Castlemead, Lower Castle Street, Bristol, Avon, BS1 3AG
  • Telephone: 0117 463 8966
  • Email: info@measuredsurveybristol.co.uk
  • Website: measuredsurveybristol.co.uk

In these Terms, “we”, “us” and “our” refer to Measured Survey Bristol. “You”, “your” and “the Client” refer to the person, organisation or entity engaging our services.

Definitions

For clarity, the following terms have the meanings set out below:

  • “Services” means the measured building surveying services described in our written quote, including (where applicable) site fieldwork, drawing production, BIM modelling, point cloud processing and delivery of agreed outputs.
  • “Deliverables” means the surveys, drawings, models, datasets and any other materials we produce and supply to you under these Terms.
  • “Quote” means the written quotation we provide describing the scope, deliverables, fee and timeline for a specific project.
  • “Property” means the building, site or premises that is the subject of the Services.
  • “Consumer” means a person acting wholly or mainly outside their trade, business, craft or profession (typically a homeowner). Consumer Clients have additional statutory rights under UK consumer protection law.
  • “Business Client” means any client who is not a Consumer (typically architects, developers, commercial property owners, contractors and other professionals).

How a Contract Is Formed

A binding contract between us is formed when:

  1. We have provided you with a written Quote setting out the scope, deliverables, fee and timeline; and
  2. You confirm acceptance of the Quote in writing (by email, signed quote return, or other written confirmation); and
  3. We acknowledge your acceptance.

Until all three steps are complete, no contract is in place and we are not obliged to commence work.

We reserve the right to decline any proposed engagement at our discretion, including (without limitation) where the proposed scope falls outside our expertise, where access to the Property cannot reasonably be arranged, or where there is a conflict of interest.

Quotes and Pricing

All Quotes are issued on a fixed-price basis, calculated on the scope of Services described in the Quote. Quotes are valid for 30 days from the date of issue unless otherwise stated.

Our Quotes are based on information provided by you, including (without limitation) property type, floor area, access conditions, deliverables required and timeline. Where the actual scope on site differs materially from the information provided — for example, where the Property is significantly larger or more complex than indicated, or where access constraints not previously disclosed are encountered — we reserve the right to revise the Quote. Any revised pricing will be discussed and agreed in writing with you before any additional work is undertaken.

All prices are stated exclusive of VAT unless explicitly stated otherwise. VAT will be added at the prevailing rate where applicable.

The Quote covers the Services and Deliverables specifically described. Additional services, revisions outside the agreed drafting stage, or scope changes requested after fieldwork is complete may be subject to additional fees, which will be quoted separately and require your written acceptance before being undertaken.

Payment Terms

Unless otherwise agreed in writing, our standard payment terms are as follows:

  • 50% deposit payable on confirmation of the engagement, before fieldwork commences
  • 50% balance payable on delivery of the agreed Deliverables
  • Payment terms of 14 days from invoice date apply to all invoices

Payment is accepted by bank transfer to the account details specified on our invoice. We do not currently accept payment by cheque or cash.

For Business Clients, late payment may be subject to interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, including statutory interest at 8% above the Bank of England base rate and recoverable compensation for collection costs. We reserve the right to suspend services or withhold delivery of further Deliverables on any account where invoices are overdue.

For Consumer Clients, late payment may attract reasonable interest at our discretion, calculated at 4% above the Bank of England base rate. Statutory consumer rights are not affected.

We reserve the right to refer overdue accounts to a debt recovery agency or to pursue formal legal action where necessary, and you will be liable for any reasonable costs incurred in recovering overdue sums.

Your Right to Cancel — Consumer Clients Only

If you are a Consumer Client and you have entered into a contract with us at a distance (e.g. by email, telephone or website) or off our business premises (e.g. at your home), you have the right to cancel the contract within 14 days of the day after the contract is formed, without giving any reason. This is your right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

To exercise this right, you must inform us of your decision to cancel by a clear written statement (by email or post to the contact details above) within the 14-day period.

Important — early commencement of services: if you have requested in writing that we begin work on the Services before the end of the 14-day cancellation period, and we begin work with your authorisation, you may still cancel within the 14 days, but you must pay us for any Services already carried out up to the point of cancellation. The amount payable will be proportionate to the work completed in comparison to the full scope.

If we have completed all the Services within the cancellation period at your written request, you lose the right to cancel.

This cancellation right does not apply to Business Clients.

Cancellation by You — Business Clients and General Provisions

If you are a Business Client, or you are a Consumer Client outside the 14-day statutory cancellation period, the following applies:

  • You may cancel the engagement at any time by giving us written notice
  • Where cancellation occurs before fieldwork has commenced, you will be liable for any non-refundable third-party costs reasonably incurred by us, plus a reasonable cancellation fee reflecting work already undertaken (such as scoping, scheduling and project administration)
  • Where cancellation occurs after fieldwork has commenced but before drawing production is complete, you will be liable for fees proportionate to the work completed, including the fieldwork itself and any drawing-production work undertaken to date
  • Where cancellation occurs after Deliverables have been substantially produced, the full Quote fee remains payable

Specific cancellation amounts will be calculated on a fair and proportionate basis and confirmed in writing.

Cancellation by Us

We reserve the right to cancel an engagement, in whole or in part, in the following circumstances:

  • Where we cannot reasonably gain access to the Property despite reasonable efforts
  • Where the scope of work, on inspection, materially exceeds what was described in the Quote and revised pricing cannot be agreed
  • Where a conflict of interest, professional or regulatory issue arises that prevents us from continuing
  • Where you breach these Terms in any material way, including (without limitation) failure to pay invoices when due
  • Where circumstances beyond our reasonable control prevent us from delivering the Services (see Events Outside Our Control below)

If we cancel an engagement, we will refund any payments made for Services not yet performed, less any reasonable costs already incurred. We will give you written notice of cancellation and the basis for it.

Your Obligations

To enable us to deliver the Services properly and on schedule, you agree to:

  • Provide accurate and complete information about the Property and the project
  • Arrange safe and reasonable access to the Property at the agreed times
  • Inform us in advance of any known hazards, restrictions, asbestos surveys, structural concerns, or other safety-relevant information about the Property
  • Inform us in advance of any tenants, occupiers or third parties whose cooperation is required for access
  • Obtain any necessary permissions from landlords, tenants, neighbours or other parties before our visit
  • Cooperate with us reasonably and respond promptly to any requests for information or instructions
  • Pay our invoices in accordance with the agreed terms

If you fail to meet any of these obligations, and that failure causes a delay or additional cost, we may charge reasonable additional fees and adjust delivery timelines accordingly.

Site Access, Health and Safety

You agree to ensure that the Property is in a safe and reasonable condition for our surveyors to attend. Our surveyors will conduct themselves professionally, follow reasonable on-site safety practices, and carry appropriate equipment.

We reserve the right to suspend or postpone fieldwork if, in our reasonable opinion, attending the Property would expose our personnel to unacceptable health and safety risks. Any rescheduling caused by such suspension will not constitute a breach of these Terms on our part.

If we attend a pre-arranged site visit and access is unavailable for reasons attributable to you (for example, no one available to admit us, key not provided, occupant refuses entry), we reserve the right to charge an abortive visit fee equal to a reasonable proportion of the Quote, reflecting the time and travel costs incurred.

Deliverables

We will produce the Deliverables in accordance with the scope and specification set out in the Quote, working to the relevant accuracy band and the Royal Institution of Chartered Surveyors (RICS) professional standards in force at the time of the engagement.

Deliverables will be issued in the file formats agreed in the Quote (typically PDF, DWG, RVT or point cloud formats as relevant).

Revisions: the Quote includes reasonable revisions during the drafting stage at no additional cost. Reasonable revisions are typically those that correct errors, clarify dimensions, or implement minor adjustments to drawing presentation. Revisions arising from a change in your requirements, or from information that was not provided to us at the outset, may be subject to additional fees agreed in writing in advance.

Acceptance: Deliverables are deemed accepted unless you raise specific objections in writing within 14 days of delivery. Acceptance does not affect any non-excludable statutory rights you may have.

Turnaround and Timelines

The timelines stated in our Quote (typically expressed in working days from a stated start point) are good-faith estimates based on the scope and complexity of the project at the time of the Quote.

While we make every reasonable effort to meet stated timelines, time is not of the essence in these Terms unless explicitly agreed in writing. Delays caused by factors outside our reasonable control — including (without limitation) restricted access, late provision of information by you, third-party delays, weather affecting site work, or events listed in Events Outside Our Control — will extend the agreed timeline by a reasonable period.

Rush / priority turnaround: where you have requested expedited delivery and we have agreed in writing, the Quote will reflect any rush surcharge. Standard timelines do not apply to projects under expedited terms.

Intellectual Property

We retain ownership of all intellectual property rights in the Deliverables, including (without limitation) copyright in the drawings, BIM models and point cloud datasets we produce.

On full payment of all sums due under the engagement, we grant you a non-exclusive, non-transferable, royalty-free licence to use the Deliverables for the purpose for which they were commissioned — typically the design, planning, construction or sale of the Property identified in the Quote.

This licence does not authorise you to:

  • Sell, sublicense or commercially exploit the Deliverables independently of the project for which they were commissioned
  • Modify the Deliverables in a way that misrepresents them as our work
  • Reuse the Deliverables for projects, properties or purposes other than those originally agreed

For commercial reuse outside the licensed purpose, separate licensing terms and additional fees may apply. Please contact us if you wish to discuss extended use rights.

We retain the right to use anonymised, aggregated or non-identifying data from completed projects for internal training, quality improvement and the development of our methodologies.

Confidentiality

We will treat all information provided to us by you, and all information obtained about the Property in the course of carrying out the Services, as confidential. We will not disclose such information to third parties except:

  • To our own personnel and authorised subcontractors who require access to perform the Services
  • To other professionals working on your project, where you have authorised disclosure
  • Where required by law, regulation or court order
  • Where necessary to enforce our rights under these Terms

We expect the same standard of confidentiality from you in relation to any non-public information we share with you about our methodologies, pricing structure or commercial practices.

Liability

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot lawfully be limited or excluded under English law, including (for Consumer Clients) liability that cannot be limited under the Consumer Rights Act 2015

Subject to the above, our total aggregate liability to you arising out of or in connection with any engagement — whether in contract, tort (including negligence), breach of statutory duty or otherwise — shall be limited to the total fees paid by you to us under the relevant engagement, except where our professional indemnity insurance provides cover for higher amounts, in which case our liability is limited to the amount actually recoverable under that insurance.

We shall not be liable for any indirect, consequential or special losses, including (without limitation) loss of profit, loss of business opportunity, loss of contracts, loss of anticipated savings, loss of goodwill, or losses resulting from delays caused by factors outside our reasonable control.

We shall not be liable for any inaccuracy, deficiency or loss arising from incorrect, incomplete or misleading information provided by you or by third parties acting on your behalf.

We carry professional indemnity insurance appropriate to the nature and scale of our work. Details of our cover can be provided on request.

For Consumer Clients: nothing in this section affects your statutory rights under the Consumer Rights Act 2015 or other UK consumer protection legislation.

Events Outside Our Control

We shall not be liable for any delay or failure to perform our obligations under these Terms where the delay or failure is caused by an event outside our reasonable control. Such events include (without limitation):

  • Fire, flood, storm or other natural disasters
  • Strikes, lockouts or other industrial action
  • Civil unrest, war, terrorism, riot or invasion
  • Pandemics, epidemics or government-imposed restrictions
  • Failure of utilities, communications or internet infrastructure
  • Acts of any government or regulatory authority
  • Any other event reasonably outside our control

If such an event occurs, we will notify you as soon as reasonably practicable and the affected timeline will be extended by a reasonable period. If the delay extends beyond a reasonable time, either party may cancel the engagement, with fees payable for work completed up to the cancellation date.

Complaints

We aim to deliver work that meets a high professional standard. If you have a complaint about our Services or any Deliverable, please raise it with us in writing as soon as possible — and in any event within 14 days of the issue arising or being identified.

We will:

  1. Acknowledge your complaint in writing within 5 working days
  2. Investigate the complaint thoroughly and fairly
  3. Provide a written response setting out our findings and any proposed resolution within 20 working days of acknowledgement, or within a longer period agreed with you

If we cannot resolve a complaint to your satisfaction, you may have the right to refer the matter to alternative dispute resolution, professional regulatory bodies (such as the Royal Institution of Chartered Surveyors where applicable), or to pursue the matter through the courts.

Data Protection

Our handling of personal information is governed by our Privacy Policy, which is available on our website. By engaging us, you acknowledge that you have read and understood our Privacy Policy and consent to the processing of personal data as described therein, where consent is the relevant lawful basis.

Variation of These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements or industry standards. The version of these Terms in force at the time you accept a Quote shall apply to that engagement, and any subsequent updates will not retrospectively affect contracts already in place.

The current version of these Terms is always available on our website, with the “Last updated” date shown at the top.

Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, or shall be severed if no such modification is possible. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with the relevant Quote and any documents expressly referred to in them, constitute the entire agreement between us in relation to the Services. They supersede any prior negotiations, representations or agreements, whether written or oral.

Nothing in this clause limits or excludes liability for fraud or fraudulent misrepresentation.

Third-Party Rights

A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term, except where expressly stated otherwise.

Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, except that Consumer Clients resident in Scotland or Northern Ireland may bring proceedings in their local courts where applicable consumer law so provides.
